These Terms and Conditions (“Agreement”) govern your use of the Africaribana mobile application (“App”), owned and operated by Jaranova Technology (“Company”). By accessing or using the App, you agree to be bound by these Terms and Conditions. If you do not agree with any part of this Agreement, please refrain from using the App.

1. User Responsibilities
1.1. Age Restriction: You must be at least 13 years old to use the App. If you are under the age of 18, you confirm that you have obtained parental or guardian consent to use the App.
1.2. Account Information: You are responsible for maintaining the confidentiality of your account credentials and ensuring the accuracy of the information you provide during the registration process.
1.3. Prohibited Activities: You agree not to engage in any unlawful, abusive, or unauthorized activities while using the App. This includes, but is not limited to, violating intellectual property rights, transmitting viruses or harmful code, harassing other users, or attempting to gain unauthorized access to the App’s systems.

2. Content and Intellectual Property
2.1. User Content: By using the App, you grant the Company a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, distribute, and display the content you post or share on the App.
2.2. Intellectual Property: All intellectual property rights, including copyrights, trademarks, and patents related to the App, belong to the Company or its licensors. You agree not to use, copy, or distribute any content from the App without prior written permission from the Company.

3. Privacy and Data Protection
3.1. Data Collection: The Company may collect and process personal information in accordance with its Privacy Policy. By using the App, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
3.2. User Consent: You agree to obtain necessary consents from other individuals before sharing their personal information or content through the App.

4. Disclaimer of Warranties
4.1. The App is provided on an “as is” basis, without any warranties or representations, express or implied. The Company disclaims all warranties, including but not limited to, fitness for a particular purpose, non-infringement, and accuracy of information.
4.2. The Company does not guarantee uninterrupted, secure, or error-free operation of the App. You acknowledge that the App may be subject to limitations, delays, and other issues beyond the Company’s control.

5. Limitation of Liability
5.1. The Company and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of the App.
5.2. In no event shall the Company’s total liability exceed the amount you have paid, if any, for using the App.

6. Termination
6.1. The Company reserves the right to suspend or terminate your access to the App at any time without notice if you violate these Terms and Conditions.
6.2. You may terminate this Agreement by ceasing to use the App and deleting your account.

7. Governing Law and Jurisdiction
7.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of laws principles.
7.2. Any legal action or proceeding arising out of or in connection with this Agreement shall be exclusively brought in the courts located in Ontario, Canada.

8. Changes to the Agreement
8.1. The Company reserves the right to modify or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised Agreement on the App.
8.2. Your continued use of the App after the modifications will signify your acceptance of the revised Agreement.
